In fact during the 1860s and 1870s, the period of the Rupert's Land transfer and the early numbered treaties, questions about the nature of land as property and about whether the ability to buy and sell land was a central Culture and Anarchy in Indian Country tenet of civilized society were being debated throughout Great Britain, and the pages of the notable journals of the period were filled with speculation about the issue.

The quite different British response to the interests of the aborigines in Australia is due in no small measure to the fact that the aborigines there were not organized into tribes. As a consequence, they were deemed to have no collective political interests that the British need bother about (leaving them instead to the vagaries of humanitarian concern for individuals). Also, they were no military threat. On the Aboriginal side in the Americas, there was clearly some anxiety (especially among the nations with a distinguished military history) about the military power of the British and the new Canadian government, just as there must have been anxiety about the military adventurism of the American army; and there was a widely shared sense of the need to make alliances for economic reasons.

For what the notion of enfranchisement affirmed was that an Indian must give up tribal allegiance, which is to say being an Indian, in order to be accepted as British or Canadian. Put simply, the 1857 Act confirmed that what we might for convenience call 'dual citizenship' was not acceptable in British North America. Indian citizenship, however, certainly was. The idea of Culture and Anarchy in Indian Country Indian tribal citizenship, and therefore of Indian tribal government, was implicit in the enfranchisement provisions.
